Es una realidad que los servicios sexuales en Colombia representan un mercado creciente en el que día a día se desarrollan relaciones que necesitan ser reguladas; de allí la necesidad de determinar específicamente cual es el régimen aplicable para la protección de los derechos de los consumidores. Los servicios sexuales y las actividades que se desarrollan en torno a ellos generan discusiones sobre la moralidad, lo que provoca una limitación frente a la adquisición y regulación que dilata los avances en la protección del consumidor. Entendemos que los consumidores son el eslabón débil de la relación que surge entre las partes, es decir, son la parte vulnerable y por ende es necesario determinar cuál es el régimen aplicable para su protección. De acuerdo con lo anterior, se pretenden superar los cuestionamientos morales que rodean la adquisición de servicios sexuales, para verlo desde un punto de vista objetivo con el fin de determinar la existencia y eventual aplicabilidad de un régimen general de protección al consumidor en este tipo de relaciones. Con la intención de establecer cuál es el régimen aplicable en el marco de la investigación, se solicitó a la Superintendencia de Industria y Comercio información con respecto al régimen bajo el cual se encuentra supeditada la adquisición de servicios sexuales en el marco de protección al consumidor, lo cual se tradujo en una remisión expresa al estatuto del consumidor, en la que dicha entidad enunció los artículos de la Ley 1480 de 2011 aplicables de manera general a las relaciones de consumo, pero no a la temática específica de esta investigación, lo cual representa un gran vacío normativo; y la falta de una debida respuesta por parte de esta entidad denota el grado de desprotección de los consumidores de este tipo de servicios. En virtud de esto, desarrollamos esta investigación de manera inicial, con un análisis de derecho comparado y de conceptos relevantes en torno a la prestación y adquisición de servicios sexuales, para que de esta manera sea posible ajustar la eventual relación de consumo al régimen general de protección al consumidor. La investigación se desarrolla en torno a la observación de los distintos métodos de prestación del servicio sexual, es decir, la presencialidad o virtualidad, el contacto físico, la forma e incluso el número de personas inmersas en la relación. Con el estudio de las diferentes modalidades en las que se puede prestar el servicio se desarrolla un análisis de las implicaciones que estas pueden tener frente a la aplicación de la Ley 1480 de 2011 y los derechos que surgen para el consumidor respecto de la adquisición de servicios sexuales. Igualmente, son analizados los derechos que surgen para los consumidores en el marco de la adquisición de servicios sexuales por medio de una investigación que pretende estudiar la relación que surge entre las partes desde un punto de vista contractual y también, desde la óptica del consumo.

Abstract
It is a reality that sexual services in Colombia represent a growing market in which day by day relationships are developed that need to be regulated; hence the need to determine specifically which is the applicable regime for the protection of consumer rights. Sexual services and the activities that are developed around them generate discussions on morality, which causes a limitation to the acquisition and regulation that delays the progress in consumer protection. We understand that consumers are the weak link in the relationship that arises between the parties, i.e., they are the vulnerable party and therefore it is necessary to determine what is the applicable regime for their protection. In accordance with the above, we intend to overcome the moral questions surrounding the acquisition of sexual services, to see it from an objective point of view in order to determine the existence and eventual applicability of a general regime of consumer protection in this type of relationships. With the intention of establishing which is the applicable regime in the framework of the investigation, the Superintendence of Industry and Commerce was requested information regarding the regime under which the acquisition of sexual services is subject to the consumer protection framework, which resulted in an express reference to the consumer statute, in which said entity enunciated the articles of Law 1480 of 2011 generally applicable to consumer relations, but not to the specific subject matter of this investigation, which represents a great regulatory gap; and the lack of a proper response from this entity denotes the degree of lack of protection of consumers of this type of services. By virtue of this, we developed this research initially, with an analysis of comparative law and relevant concepts around the provision and acquisition of sexual services, so that in this way it is possible to adjust the eventual consumer relationship to the general regime of consumer protection. The research is developed around the observation of the different methods of rendering sexual services, i.e., the presence or virtuality, the physical contact, the form and even the number of persons involved in the relationship. With the study of the different modalities in which the service can be provided, an analysis of the implications that these may have regarding the application of Law 1480 of 2011 and the rights that arise for the consumer with respect to the acquisition of sexual services is developed. Likewise, the rights that arise for consumers in the context of the acquisition of sexual services are analyzed through a research that aims to study the relationship that arises between the parties from a contractual point of view and also from the perspective of consumption.
