Resumen
El presente ensayo analiza desde una perspectiva jurídica y científica las implicaciones del régimen de derechos de obtentor vegetal (DOV) en el marco de la biotecnología moderna y su relación con la disponibilidad estable de alimentos. A partir de la Decisión Andina 345 de 1993 y del Convenio UPOV de 1991, se examina cómo la protección jurídica de las obtenciones vegetales incentiva la innovación científica, garantiza el retorno de la inversión en investigación y promueve el desarrollo de variedades más productivas, resistentes y sostenibles. Asimismo, el texto aborda las conclusiones del Seminario sobre la Protección de las Variedades Vegetales y la Transferencia de Tecnología organizado por la UPOV, destacando el valor de la cooperación público-privada en la sostenibilidad agrícola. Desde un enfoque latinoamericano, se analizan los retos que enfrenta la región —como la baja inversión en investigación y la falta de articulación institucional— frente a los avances observados en países como Sudáfrica y Japón. Se resalta la importancia de fortalecer la investigación pública y las políticas inclusivas para alcanzar un equilibrio entre la protección jurídica de la innovación, el derecho a la seguridad alimentaria y el acceso equitativo a los recursos genéticos.

Abstract
This essay analyzes, from a legal and scientific perspective, the implications of the plant breeders' rights (PBR) regime in the context of modern biotechnology and its relationship with stable food availability. Based on Andean Decision 345 of 1993 and the UPOV Convention of 1991, it examines how the legal protection of plant varieties encourages scientific innovation, guarantees a return on investment in research, and promotes the development of more productive, resistant, and sustainable varieties. The text also addresses the conclusions of the Seminar on Plant Variety Protection and Technology Transfer organized by UPOV, highlighting the value of public-private cooperation in agricultural sustainability. From a Latin American perspective, it analyzes the challenges facing the region—such as low investment in research and lack of institutional coordination—in contrast to the progress observed in countries such as South Africa and Japan. It highlights the importance of strengthening public research and inclusive policies to achieve a balance between the legal protection of innovation, the right to food security, and equitable access to genetic resources.
