Resumen
Este trabajo investigativo constituye una aproximación teórica que sirve de base para la creación del Comité de Bioética en el Hospital Universitario de Neiva. Este centro de salud recoge los casos más críticos de la Región Surcolombiana en el campo de las malformaciones congénitas en medicina perinatal, patologías que conllevan un sin numero de conflictos de difícil solución para el personal médico y la familia del paciente. La experiencia ha demostrado que el desconocimiento de los lineamientos teóricos básicos de la bioética y de una metodología de resolución de problemas viable por parte del personal de salud, y más aún, la carencia de un Comité interdisciplinario que sobre las bases antes mencionadas diriman los conflictos provenientes de la existencia de este tipo de patologías, ha traído como resultado el deterioro de la calidad de vida de familias, el sufrimiento de recién nacidos por prácticas que además de fútiles conducen al encarnizamiento terapéutico y, peor aun, a la realización de abortos eugenésicos, consecuencia de sugerencias médicas que han dejado graves secuelas psicológicas en la madre. En este intento se abordan temas no sólo de carácter ético, sino que se ahonda en los dilemas existentes en este tipo de situaciones, abarcando, a su vez, la discusión sobre procesos terapéuticos que van desde la futilidad del tratamiento médico hasta el encarnizamiento terapéutico y los distintos aspectos ha tenerse en cuenta frente al dilema que conlleva la limitación del esfuerzo terapéutico. Lo anterior se estudia en el marco del respeto por la dignidad de la persona y los lineamientos de la UNESCO y los organismos que guían los procesos tendientes a dirimir conflictos de este tipo sobre bases de carácter bioético.

Abstract
This research attempt to be a theoretic approximation that serves as a foundation for the creation of a bioethics committee in the University Hospital in Neiva. This health center receive every day the most critical cases of congenital malformations from the south of Colombia. These cases represent and generate innumerable conflicts that are difficult to handle by the medical team and the patient’s family. Several factors have contributed to the increase of the just born babies suffering and the deterioration of the quality of life of their families. First, the medical team’s lack of knowledge regarding basic bioethics theoretic concepts; second, the absence of a methodology that helps the health care team solve problems; last of all, the unavailability of an interdisciplinary committee that resolves the conflicts that merge as a result the care of patients with congenital malformations. Indeed, there is a dramatic increase in the baby’s suffering caused by the applying of unnecessary therapeutic practices leading the medical crew to fall in therapeutic enraging or even worst in the realization of eugenesic abortions. As a result of these situations, severe psychological sequelae are developed by the mothers of the affected neonates. This research makes a detailed review of the ethical issues and dilemmas regarding congenital malformations and includes a discussion about therapeutic processes involved in the increase of patient and families suffering, from useless treatment to therapeutic enraging. In addition, this paper analyzes different aspects that must be taken into account with regard to dilemmas concerning the therapeutic efforts limitation. All of the above is studied in the context of the respect for the human dignity and following the lineaments of UNESCO and other organizations that guide processes leading to the resolution of conflicts of this character from the point of view of bioethics.
