Análisis de la eficiencia y efectividad de los procesos sancionatorios abiertos del recurso hídrico en aguas superficiales, emitidos por la Corporación Autónoma Regional de Cundinamarca Dirección Regional Sabana Centro para la vigencia 2016 y 2017

Resumen

Colombia es reconocida por la evolución de su política y legislación ambiental (Environmental Democracy Index, 2015); sin embargo, en el país se experimenta incertidumbre y en muchas ocasiones limitada capacidad de las instituciones del Estado para verificar el cumplimiento y hacer un seguimiento eficaz y efectivo a los requerimientos de obligatorio cumplimiento contenidos en los diferentes actos administrativos emitidos por las autoridades ambientales. Este trabajo tiene como marco de referencia las Leyes 99 de 1993, Decreto-Ley 2811 de 1974 y el eje central de la temática sobre el Régimen Sancionatorio Ambiental: la Ley 1333 de 2009. Por lo anterior, la gestión pública de la Autoridad Ambiental en Colombia debe contar con instrumentos para responder de forma adecuada y suficiente, con los recursos y herramientas disponibles, a los objetivos que persigue la política ambiental. El principal objetivo de este trabajo es estimar la eficiencia y efectividad en los procesos sancionatorios emitidos por la Corporación Autónoma Regional de Cundinamarca, Dirección Sabana Centro, durante las vigencias 2016 y 2017, sobre el recurso hídrico, específicamente sobre aguas superficiales. Lo anterior mediante un enfoque cuantitativo con alcance exploratorio, descriptivo y correlacional. El trabajo se desarrolló en tres etapas: I. La estructuración de una base de datos mediante el sistema SAE, II. Analizando variables (Tipo de afectación en los procesos sancionatorios, Tipo de sanciones, Estado del proceso, entre otras) por medio de estadística descriptiva con el propósito de reducir la información mediante un conteo y cálculo de porcentajes y midiendo indicadores de eficiencia y efectividad para las variables tiempo y productividad. Por último, la etapa III. Desarrolla un diagnóstico del estado actual de los procesos y de la Corporación en general mediante una Matriz DOFA la cual es útil de igual forma para generar estrategias de prevención. Finalmente, se obtuvo que 43814 registros, los cuales 498 corresponden a aguas superficiales y 248 para los procesos abiertos durante la vigencia 2016-2017, los cuales en su mayoría se encuentran en trámite, adicionalmente el tipo de afectación más recurrente en los procesos sancionatorios es por captación ilegal y vertimientos que se les atribuye a los municipios de Cogua y Zipaquirá. Siendo captación ilegal el proceso que más finalizaciones tiene en los expedientes. De tal manera que, los procesos sancionatorios a cargo de la DRSC no están siendo eficientes y efectivos, esto aplicado en la matriz DOFA indica que la medida que debe reforzarse es el seguimiento y control dispuesto mediante comisiones técnicas o alianzas con otras autoridades.

Abstract

Colombia is greatly known for its environmental politics and regulations (Environmental Democracy index, 2015); however, the country faces great uncertainty and, often, a limited capacity of Government institutions to effectively, and efficiently, verify and track the complying of mandatory requirements enshrined in the different administrative acts issued by Colombian Environmental authorities. This paper relies on acts: Law 99/1993, Executive order 2811/1974 and, as the central axis of this matter, on the Environmental Sanctioning Regime: law 1333/2009, as its reference framework. Based on the aforementioned, the Environmental Authority’s public management must count with the proper instruments to adequately, and sufficiently, respond, making use of the available tools and resources, to the goals at which environmental politics aim. The main objective of this paper is to estimate the efficiency and the effectivity of sanction processes conducted by “Corporación Autónoma Regional de Cundinamarca, Dirección Sabana Centro” (Regional Autonomous Corporation of Cundinamarca, Center Savannah Office) for 2016 and 2017 regarding hydric resources, specifically surface water, and to present a results and conclusions analysis; which will provide evidence on the productivity and response time of said Corporation. The previous thing by means of a quantitative approach with exploratory, descriptive and correlational scope. The work was developed in three stages: I. The structuring of a database through the SAE system, II. Analyzing variables (type of affectation in sanctioning processes, type of sanctions, status of the process, among others) by means of descriptive statistics with the purpose of reducing information by counting and calculating percentages and measuring indicators of efficiency and effectiveness for the Variable time and productivity. Finally, stage III. It develops a diagnosis of the current state of the processes and of the Corporation in general through a SWOT Matrix which is useful in the same way to generate prevention strategies. Finally, 43814 records were obtained, of which 498 correspond to surface water and 248 to open processes during the 2016-2017 period, which are mostly in process, in addition the most recurrent type of affectation in the sanctioning processes is by illegal collection and dumping that is attributed to the municipalities of Cogua and Zipaquirá. The process that has the most finalities in the files is illegal. In such a way that, the sanctioning processes in charge of the DRSC are not being efficient and effective, this applied in the DOFA matrix indicates that the measure that must be reinforced is the monitoring and control arranged through technical commissions or alliances with other authorities.
